Nokia Good Things Competition - Official Rules

Before participating please read through and accept these Official Rules and the Privacy Policy (http://www.nokia.co.uk/home/privacy-policy) By taking part in this competition, you will be created a Nokia Music Store account subject to its Terms of Use (http://music.nokia.co.uk/?redirect=termsAndConditions). If you do not accept or agree with at least one of those set of rules, you should not take part in this competition as you will not be eligible to participate.

The “Nokia Good Things” competition (the "Promotion" for short), brought to you by Nokia UK Limited (the "Promoter" for short) will be governed by these rules (the "Official Rules" for short).

1. ELIGIBILITY

To be eligible to participate you must be at least 18 years of age and you must hold a Nokia Music Store account. The Promotion is open to participants/contestants ("Participants" for short) residents in the UK only.

Employees and directors of Promoter and its licensees, advertising, promotion or production agencies and provider companies (and their respective dependents, immediate family members and individuals residing in their same household) are not eligible to participate.

The Promoter and its associated companies reserve the right, at any time, to verify the eligibility of Participants.

2. PROMOTION PERIOD

The Promotion begins on 23rd October and will run until midnight (UK time) 25th November 2009 (the "Promotion Period" for short).

The website http://goodthings.nokia.co.uk  (the "Site" for short) will inform Participants of the Promotion Period and when it has expired.

3. HOW TO PARTICIPATE

The Promotion will allow Participants to be entered into the Nokia Good Things competition, where each Participant can win the chance to watch Alexandra Burke perform a live gig at one of 500 pre-selected towns in the UK (as listed on the website) by voting for one the towns as the venue.

To participate in the Promotion, Participants must submit their contact details (name, e-mail and contact number) and their vote for one of the short listed towns (as displayed on the website) via the Site http://goodthings.nokia.co.uk.

Each of the participants that have completed their registration correctly will be created a Nokia Music Store account. They will be notified of their new Nokia Music Store account sign-in details via e-mail address provided.

To access the Site, Participants must have access to the World Wide Web (internet) provided by an Internet Service Provider ("ISP") of their choosing and must pay any applicable ISP, operator, service and other fees for such access.

4. THE INFORMATION SUBMITTED BY YOU

Promoter respects the privacy of its customers and the information submitted by the Participant will only be used by Promoter, in accordance with the Participant’s instructions upon entry and with applicable data protection regulations and the Promoter’s privacy policy (the "Privacy Policy" at http://www.nokia.co.uk/home/privacy-policy). Please consult the Privacy Policy for more details on how Promoter handles information submitted by you ("Personal Information" for short).

5. PRIZES

Minimum of 50 Winner(s) will each be awarded with 2 tickets to the Alexandra Burke exclusive gig in the winning town.

The top five Participants of the winning Town who get the most people to enter the competition by sharing the competition message via email or Social media applications (as defined by the Promoter) directly from the competition website (http://goodthings.nokia.co.uk)  will each be awarded automatically with 2 tickets to the Alexandra Burke gig at the winning town.

The Prize does not cover any travel to or from the town where the Alexandra Burke gig is hosted.

The Prize(s) cannot be assigned, transferred, redeemed for cash, or substituted except by Promoter who may, at its sole discretion, substitute any Prize with one of comparable value if the advertised Prize becomes unavailable for any reason.

6. DETERMINATION OF THE WINNER

The Participants that voted for the town that wins the chance to hold the Alexandra Burke gig will be automatically entered into a prize draw .Winner(s) will be selected at random from the Participants that voted for the winning town. The choice of winner(s) is at sole promoter’s discretion and no correspondence will be entered into. The winners’ names and counties will be available from the Promoter on request.

The town that will win the chance to host the Alexandra Burke gig will be selected based on a percentage of the amount of votes it receives to the total population of each town (i.e. if 1,000 people vote for a town with a population of 10,000 then it would beat a town that receives 5,000 votes but has a population of 100,000 people).

The winners will be sent a notice via email or phone provided by the Participant while submitting their details via the Site no later than the w/c 30th November 2009. After receiving a winning notification, the winner must confirm their participation within five (5) days after being contacted by the Promoter.

If the winner fails to contact the Promoter within the five (5) day time period after notification, the winner shall forfeit the Prize. In this event, Promoter shall select another winner from the remaining eligible entries or dispose of the Prize in any way it deems fit.

To the fullest extent permitted by law, Promoter shall not be liable for any direct, indirect or consequential loss or damages whatsoever which is suffered in relation to the delivery of the Prize to the winner and/or this Promotion.

7. GENERAL RULES

By taking part in this competition, Participants consent to comply with these Official Rules and the Privacy Policy.

Other than for death or personal injury arising from negligence of the Promoter or for anything else that cannot be excluded by law, so far as is permitted by law the Promoter excludes all liability for any disappointment, loss, damage, injury, cost and expense, whether direct or indirect, howsoever caused in connection with the Promotion or any aspect of the Prize.

If a winner is found to be ineligible or not in compliance with these Official Rules the winner's Prize will be forfeited and an alternate winner selected.

No purchase is necessary.

8. RIGHT TO USE ANY SUBMITTED CONTENT

By submitting, and upon such submission of, any information or materials such as (but not limited to) data, text, photographs, likeness, messages, voice, answers, or the like, or any other material (the "Content" for short) to Promoter or through the Site, you license and grant to Promoter a non-exclusive, royalty-free and free of charge, perpetual, worldwide, irrevocable, and fully sub-licensable right to use, reproduce, copy, modify, adapt, communicate to the public, make available, publish, translate, create derivative works of, distribute, and display such Content or any concept described in it throughout the world in any media, product and/service so that the Promoter may make the fullest use of the Content, without compensation, or any restrictions on use, accountability or liability, and with waiver of all moral rights to the extent permitted by applicable laws.

Promoter may expect the winner of the Promotion to take part in reasonable publicity relations activities and promotional events promoting Promoter products. Any appearance made by the winner will be subject to a separate agreement made between Promoter and the winner.

9. INTERNET

Neither Promoter nor its associated companies can accept any responsibility for lost, late, damaged, misdirected, unintelligible, or interrupted entries, which shall be deemed invalid. Proof of submission of entry will not constitute proof of receipt of entry.

To the fullest extent permitted by applicable law, Promoter is not responsible for loss or damage to Participants' or to any other person's computer related to or resulting from participating in the Promotion or downloading materials from or use of the Site. Should any portion of the Promotion be, in Promoter's sole opinion, compromised by virus, worms, bugs, non-authorized human intervention, technical failures or other causes which, in the sole opinion of Promoter, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Promoter reserves the right at its sole discretion to suspend, modify or terminate the Promotion, and select the winner at random from all entries received prior to action taken or as otherwise deemed fair and appropriate by Promoter.

11. MISCELLANEOUS

These Official Rules are governed by the laws of England and Wales.

To the maximum extent permitted by applicable law, Promoter reserves the right at its sole discretion to amend, withdraw or revise these Official Rules and the Prizes at any time without notice and in such event Promoter shall not have any liability whatsoever.

You acknowledge and agree that no form of cheating will be tolerated. Any persons found cheating, as determined in the sole and absolute discretion of Promoter, will immediately be disqualified from the Promotion. Cheating includes, but is not limited to, tampering, hacking of website, entering the Promotion without meeting the eligibility requirements, using any automated software or device to gain an advantage during the Promotion, exploiting any software bugs, use of the Promotion beyond the defined rules of the Promotion, attempting to disable or overwhelm any of the Promoter sites, attempts to disrupt any portion of the Promotion, including, but not limited to, allowing somebody else use your Personal Information, tampering with entry process or operation of promotion or Site.

CAUTION: ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE ANY OF THE PROMOTER SITES OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS; AND SHOULD SUCH AN ATTEMPT BE MADE, PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

You acknowledge and agree that all disputes in relation to the Promotion shall be determined in the sole and absolute discretion of Promoter, and that such a decision shall be final and binding.
